Overview
By using or accessing the Miso-box website, owned and operated by Bit Ltd. (referred to as “Miso-box”), you acknowledge that you have read, comprehended, and agreed to the provided Terms of Service (“Terms” or “Agreement”). If you disagree with these Terms, please refrain from using the Miso-box website. Miso-box retains the right to modify these Terms by updating this page, and it is advised to periodically review them. By using this site, you affirm that you are at least 18 years old or under the supervision of an adult or guardian with the authority to enter into a binding legal agreement. You are granted a personal, limited, non-transferable, non-exclusive license to access and use the Miso-box site. We may revise products, services, or site rules without notice, and access may be revoked for any reason without notice.
Section 1 – Use of the Website: Permission is granted for you to access and use the Miso-box site for personal use. Mechanized or systematic information harvesting, for any purpose, including commercial use, is strictly prohibited. Unauthorized use, reproduction, distribution, display, or transmission of site content is prohibited. Do not alter or remove proprietary notices from downloaded materials. Printing information for personal use is allowed. You may not modify, reformat, copy, display, distribute, transmit, publish, license, create derivative works, transfer, or sell information obtained from this site. Displaying site content on your website is not permitted without written permission. Your access to the site does not grant rights to celebrity spokespersons’ intellectual property. We may change site information, features, and functions without notice. Access may be denied if you violate this Agreement, our rights, or third-party rights. Passwords and account identification may be assigned, and you are responsible for their security. Notify Miso-box of any unauthorized use.
Section 2 – Registration and Membership: Monthly boxes for Miso-box and other subscription boxes are shipped to the provided address. Membership can be canceled without charge through the Customer Portal or by contacting Customer Support.
Section 3 – Billing and Payments: As a Member, you agree to provide accurate contact and payment information. Charges may be added for global shipment disruptions. You are responsible for fees or charges from your bank or credit card provider. Address updates must be made 48 hours prior to the renewal date. Payments are final and non-refundable.
Section 4 – Your Subscription Contract: Your subscription has an initial and recurring payment feature. By purchasing, you accept responsibility for all recurring charges. To cancel, contact support 48 hours before the renewal date. Cancellations after this period will be effective for the following renewal. Cancelled subscriptions are eligible until the end of the current term. Periodic charges may occur until cancellation. Cancellation does not warrant a prorated refund. Subscription reactivation generates a new order. Plan and price changes may occur with or without notice. Subscription revocation is at Miso-box’s discretion. Membership is void where prohibited by law.
Section 5 – Shipping: Insurance: All Miso-boxes with trackable shipping are automatically covered by insurance. Cases Covered by Insurance:
Theft: Stolen boxes can be replaced if evidence is provided from the shipping company acknowledging misplacement or theft.
Damage due to natural disasters (fires, floods, hurricanes, etc.).
Missing or damaged boxes due to mishandling by your local courier. Note: Boxes not received due to an incorrect shipping address or intentionally declined by the subscriber are not eligible for replacement. Missing or Damaged Items:
Missing Items: Report within 7 days for replacement or refund.
Damaged Items: Report within 7 days for replacement or refund. Required Evidence:
Pictures of all sides of the box (applies to both missing and damaged item cases).
Pictures of all items received in the box (applies to both missing and damaged item cases).
Pictures of individual items, clearly showing the damage in question (applies to damaged item cases). Damaged Items Review: A support agent will review damaged items, and a replacement or refund will be issued only for damaged products. This does not cover damage to the packaging. Returned Boxes Policy: Returned boxes will be reshipped with an additional re-shipping fee, unless the return is due to our own mistake. Boxes returned due to an incorrect shipping address or incomplete shipping address are not eligible for refunds. Policy Update: This policy can be updated at any time without prior notice and is applicable immediately and retroactively for all subscriptions and subscribers.
Section 6 – Allergen Information: Miso-box refrains from providing allergen information for Japanese products within Miso-box subscription boxes. Allergen details for common allergens are available in the booklet provided with the Sakuraco subscription box. Despite our best efforts to provide accurate information, the list is not exhaustive, and Miso-box cannot guarantee that every item is allergen-free in all subscription boxes.
Section 7 – Refer-A-Friend Program: Referrer Responsibilities: Tax liability resulting from Miso-box’s Refer-a-Friend Program falls under the responsibility of the Referrer. Referred Customer: There is no maximum limit for Referred Customers. The Referrer Customer and the Referrer cannot be the same person. The Referred Customer must have different information, including email address, billing, and shipping information from the Referrer. Referral Credit: Credit is added if the Referred Customer has already completed the purchase, and the credit will be shown as pending credit. There is no maximum credit limit. Pending Credit: Pending Credit is the credited amount for each purchase by the Referred Customer. Pending credit is unusable until approved. Credit Earned: Credit Earned is approved pending credit, sanctioned 30 days after we ship the Referred Customer’s first box. Cancelled Credit: Credit will be cancelled if the Referred customer cancels the purchase, or the purchase is being cancelled due to reasons such as fraud and cancellation. Refunded Credit: Credit will be refunded if the Referred Customer files a chargeback during the 30-day period. Credit Usage: Referrers can only redeem the available approved credits and the plan’s price. Credit Usage history is available to track usage. Sharing Referral Links: Referrals should only be used for personal and non-commercial purposes. Referral links should not be published or distributed on public forums, coupon sites, or other websites created to take advantage of referral traffic. Users are prohibited from “spamming” anyone with referral invitations. Limits on Use of Referral: Referral Codes shared by Referrers cannot be combined by Referred Customers. A Referral Code can only be used for an individual’s first subscription purchase. Miso-box’s Referral program may not be combined with other promotions or incentives. Referral and Rewards Codes are not transferable, have no cash value, and cannot, under any circumstances, be redeemed for gift cards, cash, or any cash equivalent. Subscriptions purchased using credit cannot be refunded in cash payment under any circumstance. Eligibility: Participation in the Program is limited to individuals only. Miso-box’s Referral Program cannot be used by businesses or for affiliate lead generation or similar purposes. The use of multiple accounts, email addresses, online identities, or aliases to circumvent the eligibility requirements and/or other limitations of these Terms is prohibited and may result in exclusion from the Program and the cancellation of all related rewards. Right to Modify and Cancel Accounts: Miso-box reserves the right, in our sole discretion and without notice to you, to cancel a credit, to change and close the account of any Referrer and Referred Customer if the accounts are not being used properly, violated Terms of Service, law, statute, or governmental regulation, and we will not be liable to you or to any third party for doing so. Termination and Changes: Miso-box may suspend or terminate the Referral Program or a user’s ability to participate in the Referral Program at any time for any reason. We reserve the right to suspend accounts or deduct credits if we notice any activity that we believe is abusive, fraudulent, or in violation of the Miso-box Terms of Service. We reserve the right.
Section 8 – Product Information; Limitation on Quantities: Excluding any content submitted by Members, we aim for completeness and reliability in the information on the Miso-box Site. Certain information may contain errors which we may correct without liability. We reserve the right to limit quantities purchased by Members and to revise, suspend, or terminate an event or promotion at any time without notice. We do not guarantee the availability of all products described on our Site.
Section 9 – Copyright: The technology underlying and the entire content included in the Site are copyrighted as a collective work under Japan and other copyright laws, the property of Miso-box, and protected by copyright and other intellectual property or proprietary rights. Copyright 2015-2018 Miso-box. All rights reserved. We do not investigate to determine if such works are accurate nor can we provide assurance that all such works are free of typographical errors. We cannot guarantee information displayed on this Site to be 100% accurate.
Section 10 – User Generated Content: By sharing, submitting, and uploading any of your data, including but not limited to photographs, images, video, music, art, or comments, you grant Miso-box a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, reproduce, prepare derivative works of, display, and perform your user data for the benefit of Miso-box. You acknowledge and agree that you are solely responsible for all the user data that you make available through Miso-box. Accordingly, you represent and warrant that: (1) you have all rights, licenses, consents, and releases necessary to grant Miso-box the required rights to disseminate any user data; (2) neither your data nor your posting, uploading, publication, submission, or transmittal of this data or Miso-box’s use of your uploaded data will infringe, misappropriate, or violate a third party’s intellectual property rights or result in the violation of any applicable law or regulation.
Section 11 – Warranty Disclaimer: Except as otherwise specifically provided, the site and the products offered on the site are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Miso-box disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Miso-box does not represent or warrant that the functions contained on the site will be uninterrupted or error-free, that defects will be corrected, or that the site or the server that makes the site available is free of viruses or other harmful components. Miso-box does not make any warranties or representations regarding the use of the materials on the site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability, or otherwise.
Section 12 – Limitation of Liability: Miso-box and its celebrity spokespersons disclaim liability for any indirect, incidental, special, or consequential damages resulting from the use of, or the inability to use, the site or materials on or provided through the site, even if Miso-box has been advised of the possibility of such damages. In no event will Miso-box’s liability exceed the amounts you paid to Miso-box in connection with your Miso-box membership. If a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Miso-box reserves the right to refuse or cancel any orders placed for the product at the incorrect price. Miso-box assumes no liability for injury or damage caused by products within the box. These Terms apply to you upon your access to the Site. These Terms, or any part of them, may be modified or terminated by Miso-box without notice at any time, for any reason. Miso-box reserves the right to limit discount codes to one per customer at its sole discretion. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification, and Miscellaneous shall survive any termination of these Terms and your use of the Site.
Section 13 – Taxes: Your total price includes the product price plus any applicable sales tax, which is based on the shipping address and the sales tax rate in effect at the time of your purchase. We will charge tax only in states and other territories where the goods sold over the internet are taxable. Bit Ltd. is not responsible for import tax, custom tax, and other taxes charged by the local authority.
Section 14 – Notice: Miso-box may provide notice to you via e-mail, a general notice on this Site, or by other reliable methods.
Section 15 – Use of Site: Using the Site for any illegal or unauthorized purpose is strictly prohibited.
Section 16 – Indemnification: You agree to indemnify, defend, and hold harmless Miso-box, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to the use of the Site (including negligent or wrongful conduct) by you or any other person accessing the Site using your Internet account.
Section 17 – Discount Codes: Except as explicitly permitted through this site, you agree not to sell, license, rent, lease, modify, distribute, copy, reproduce, publicly display, publish, transfer, edit, catalogue, aggregate, or create derivative works from discount codes received on or from this site.
Section 18 – Privacy: Registration data and certain other information about you are subject to our Privacy Policy. You understand that the technical processing and transmission of this Site may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
Section 19 – Third-Party Links: In an effort to provide increased value to our visitors, Miso-box may link to sites operated by third parties. However, Miso-box has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Miso-box. These linked sites are for your convenience, and you access them at your own risk. Nonetheless, Miso-box seeks to protect the integrity of its Site and the links placed upon it and requests feedback on its own Site and linked sites.
Section 20 – Trademarks: “All trademarks, service marks, and trade names of Miso-box on the Site are trademarks or registered trademarks of Miso-box or their respective owners.”
